License agreement

for sisyphus-based ALT Starterkit and software applications included therein

1. Agreement information

1.1. Parties to the Agreement

This license agreement (hereinafter — the Agreement) is made between BaseALT LLC, the holder of the rights to ALT Starterkit (hereinafter — the KIT), and you, the owner of a copy of the KIT.

1.2. Subject matter of the Agreement

This Agreement regulates the owner of a copy of the KIT's rights to use the KIT, as well as the individual software applications included into the KIT (hereinafter — the PROGRAMS), other results of intellectual activity and means of individualization, to the extent set forth in this Agreement.

1.3. Making of the Agreement

This Agreement is a contract for granting a simple (non-exclusive) license to use the KIT, made using the simplified procedure (based on open licensing, the Article 1286.1 of the Civil Code of the Russian Federation). First use of the KIT by the User, as it is defined by the specified conditions, implies the User's consent to enter the Agreement.

2. Rights of the owner of a copy of the KIT

2.1. Rights to the KIT

This KIT includes both free and non-free components licensed for redistribution by corresponding copyright owners. BaseALT LLC holds copyright to the KIT as a composite work.

The KIT as a composite work is provided under the terms of the GNU General Public License version 2 or (at your option) any later version; thus, you are granted the following non-exclusive rights to this composite work. The source profile used to build a particular KIT is included into it on the same terms.

As a person who lawfully owns a copy of a computer program, the owner of a copy of the KIT has the right to "freely reproduce" the KIT in accordance with the provisions of the applicable copyright laws regardless of the provisions of this Agreement or license agreements for the individual PROGRAMS included into the KIT.

2.2. Use of free programs included into the KIT

All free PROGRAMS included into the KIT are accompanied by license agreements, which for an unlimited period of time and at no fee grant you the following non-exclusive rights effective in the territory of any country:

• right to use the PROGRAMS (copies of the PROGRAMS) on unlimited number of computers for any purpose;
• the right to modify the PROGRAMS, as well as to publish and distribute the modifications at no charge or at a charge (at your discretion) under the conditions of the license to the original PROGRAM;
• the right to transfer the PROGRAMS to third parties at no charge or at a charge (at your discretion) without making any payments to the copyright holders;
• the right to freely receive and study the source code of the PROGRAMS.

For three years after the effective date of this Agreement, BaseALT LLC shall provide source code of any free PROGRAM included into the KIT via the Internet at your request.

2.3. Use of non-free programs included into the KIT

For all non-free PROGRAMS included into the KIT, corresponding permissions of the rights holders for their distribution as part of the KIT and for their use by end users have been obtained.

2.4. Use of the KIT's design elements and text on its cover or box

BaseALT LLC's exclusive rights to the KIT's design elements, texts and means of individualization are protected by the Fourth Part of the Civil Code of the Russian Federation. Using them separately from the KIT is prohibited unless a written consent is obtained from BaseALT LLC.

2.5. Other rights

The right of authorship, right to name and other personal non-property rights of the author, which are inalienable according to the applicable national laws, or which are not granted to you by the applicable laws or license agreements for the individual PROGRAMS included into the KIT, are reserved by their owners and are not granted to the owner of a copy of the KIT.

2.6. Reports on use of the KIT

BaseALT LLC does not require the owner of a copy of the KIT to submit reports on the use of the KIT.

3. Liability of the parties

Copyright rights to the PROGRAMS included into the KIT, including the exclusive right to authorize the use of the PROGRAMS are protected by the applicable copyright laws, including the applicable international copyright treaties. All the responsibility for observing the national laws when using the PROGRAMS included into the KIT lies with the user.

BaseALT LLC shall replace KIT carriers with manufacturing defects.

The PROGRAMS included into the KIT are distributed in the hope that they will be useful, but without warranty of fitness for a particular purpose. BaseALT LLC shall not be liable for any possible damage, direct or indirect, due to the use of these PROGRAMS.
